Salhany’s Police Manual: “Refusal of Citizen to Identify Self:  The common law does not require a citizen to identify himself or carry identification of any sort.

Do you need to present ID when asked by police (vs peace officer)?

Are you a regulated person in a regulated activity? (not common law). Then usually yes.

If you are not a regulated person, not in a regulated activity, and there is no first hand witness declaring they saw you commit a common law crime (harm or threat of harm to person or property) then you have no obligation to provide ID if requested... (common law). Police CAN ask and you can (politely) decline.

In Canada, there is no general police power to detain, arrest, or search a person who refuses to provide identification.

It is not an offense to refuse to identify yourself. It is your right to refuse.

Or you could always create your own common law id that says “common law” on it! Provide as little private information as you are comfortable with and give that when asked!

Do you need a license to drive a motor vehicle (commercial). Yes.
Do you need a license to travel in an automobile? (private – common law) No.

Most lose in their administrative courts, trying the common law position in the wrong jurisdiction.

To win you cannot be standing in their court and do so!
The place you win is before court.
Showing up in court to fight means that you agree to them have jurisdiction over you and you are no longer in common law!

If you claim ahead of time to be in common law their civil law claims against you are irrelevant until you walk into their court!

Keep in mind the people successful with the private position never have "winning" decision on the public record as the case never gets to the point of decision for the record. It just is not possible!
